Israeli Central Court Forces Interior Ministry to Grant Immediate Residency Permit & To Approve Two Family Reunification Applications

The Israeli Central Court has recently issued a decision, forcing the Israeli Interior Ministry to grant immediate residency permit to Khawlah Odeh's husband after it was withdrawn early this year.

In addition to granting immediate residency permit, the court decision included an admonition to the Interior Ministry and the Liaison & Coordination Office (LCO) for their negligence in recording by error criminal cases against Khawlah Odeh's husband.

The legal case, which was lodged against the Interior Ministry, is the third of its kind, given that in 2005 the Ministry approved the family reunification application submitted by Mrs. Odeh through the Center to obtain a residency permit for her husband.

In 2006, the Center lodged a second legal case after the residency permit was withdrawn from Khawlah Odeh's husband for criminal obstruction. After examining the evidences, the Central Court, however, did not find any criminal obstruction. For that reason, the Interior Ministry was forced to take back its decision immediately.

Once again in 2007, the Interior Ministry withdrew the residency permit from the husband under the same pretext. This time, the court decision was strict. The court forced the Interior Ministry to give the residency permit back to the husband, and sent a strongly-worded admonition to the Ministry and the Liaison & Coordination Office.

In another development, the legal unit has recently succeeded in obtaining a court decision forcing the Interior Ministry to handle Wael Dibeh's wife family reunification application. [Wael Dibeh is a resident of Jerusalem]. Mrs. Dibeh holds a Jordanian nationality. She was granted a residency permit.

At that time, the Interior Ministry refused to approve the family reunification application for criminal obstruction against Wael Dibeh for transporting passengers from the West Bank in his car. Therefore, his wife was denied freedom of movement and was unable to visit her relatives in Jordan for years.

It should be noted that the Center succeeded earlier in obtaining a court decision forcing the Interior Ministry to grant a family reunification to Walid Dibeh's Wife. [Walid Dibeh is Wael's brother]. Mrs. Dibeh also holds a Jordanian nationality.
