50,000-Shekel Fine Imposed on a Palestinian Jerusalemite for Building without a Permit

The Jerusalem Municipal Court in West Jerusalem imposed a 50,000-shekel fine on Omar Abu Diab after he was accused of building a 250-square meter house without obtaining a building permit in Jabal Al-Mukabber of Occupied East Jerusalem. He was given a one-year period to obtain a building permit.

JCSER's Lawyer, Farid Mahajneh, who followed up the case file, was able to convince the court judge to cancel the confession made by the accused, and to prove that the house was built five years ago, through the contradictions in the statements of the municipality's inspector who committed legal errors in his report during his visit to the house in March 2005. Errors include the failure of the inspector:

  • To record the statements made by Mr. Abu Diab immediately after visiting the house. In other words, the statements were recorded a long period after visiting the house;
  • To show Mr. Diab the statements attributed to him;
  • To ask for his signature on the statements;
  • To verify the year in which the house was built.

As a result, the Municipality was forced to reduce the amount of the fine from 170,000 shekels to 50,000 shekels.

The Center's Director General,noted that the municipality's inspectors, as well as other official Israeli institutions, take advantage of Palestinian Jerusalemites' ignorance of the Hebrew language in their investigations.

He called on Palestinian Jerusalemites not to answer to any question or to sign any document in Hebrew unless they are translated into Arabic.
