JCSER Obtains Approval of Child Registration

The Jerusalem Center for Social & Economic Rights (JCSER) was recently able to obtain the Israeli Interior Ministry's approval of the child registration application, which was submitted by Ibtisam Hamoudeh, a Palestinian Jerusalemite resident of Ath-Thori neighborhood, south of Jerusalem's Old City many years ago. The application was repeatedly refused by the Interior Ministry despite the fact that some of the applicant's children are over 18 years of age. Enforce

JCSER lawyer Farid Mahajneh, who followed-up the case file, noted that the Interior Ministry offered him a deal to reach a settlement without the need to approach the court. The settlement states the Interior Ministry's approval to register the applicant's five children on her Jerusalem ID card, although some of them were registered on their father ID card - a resident of the West Bank.

The lawyer noted that the Interior Ministry had previously been refusing to register children over 14 years of age on one of the parents' ID Cards following the Interior Minister's March 2002 decision to 'freeze' action on all Palestinian residents' family reunification applications.

Lawyer Mahajneh noted that the Interior Ministry's approval to register the applicant's children was for two considerations: first, the application was submitted several years ago prior to the Interior Minister's March 2002 decision to 'freeze' Palestinian residents' family reunification applications; second, the Interior Ministry's fear to approach the court. A court decision in favor of the applicant will turn the case into a legal unprecedented.

For his part, JCSER Director General said, 'the importance of such decision lies in the possibility of hundreds of longstanding child registration applications, which were submitted prior to the Israeli Interior Minister's March 2002 decision, to benefit from it.'

With this decision, the applicant's children will be granted two-year temporary residency permits (ID cards) and, afterwards, will be granted permanent residency permits. By obtaining permanent residency permits, they will be entitled to their social, economic & health rights.

He expressed hope that such decision will provide the opportunity to handle large numbers of similar applications, given the fact that child registration is one of the most complicated problems faced by many Palestinian Jerusalemites.
