JCSER Obtains Two family Reunifications Approval

Respite the Israeli Interior Minister's March 2002 decision to 'freeze' Palestinian residents' family reunification applications, the Jerusalem Center for Social & Economic Rights (JCSER) was able to obtain the Ministry's official approval of two family reunification applications submitted by Issa Al-Ja'bari & Abed Tufaha several years ago.

The Center's lawyer, Farid Mahajneh, who followed-up the case files, said, 'The Interior Ministry had previously turned down the family reunification applications under the pretext that they have criminal files. They were accused of transporting workers with West Bank ID cards to Israel illegally. As a result, we decided to approach the court following numerous memos with the Interior Ministry, thus forcing it to send memos stating its approval of the family reunification applications.'

The lawyer confirmed that the Ministry's pretext for its deliberate delay in granting its approval was weak, and therefore, was forced to approve the applications.

The Center's Director General,said, 'Under the pretext of criminal files, the Interior Ministry has delayed processing large numbers of longstanding family reunification applications, causing damage to Palestinian families waiting for the unification of their family members.'

He regards the Ministry's unjustified pretexts as a total disregard of the rights of hundreds of families whom the law guarantees their right to live together. The Ministry's retraction to its position to resort to the court proves the weakness of its pretexts and the fact that cannot stand before the power of law.

He pointed out that the Interior Ministry - based on procedures related this time to security reasons - withdraws its approval of previous family reunification applications for spouses from the West Bank or women married to Jerusalemites under the pretext that the relatives of one of the couples was arrested for security reasons, even if it is not a close relationship. This means that every citizen from the West Bank who had previously obtained a temporary residency permit in Jerusalem will be subject to questioning and the right to residency will be withdrawn if one of his relatives was put in jail for security reasons.
