Interior Ministry Forced to Register Jerusalemite Child on his Mother's ID Card

An Israeli court forced the Israeli Interior Ministry to approve the registration of a Jerusalemite child on his mother's ID card. The Ministry had previously been refusing to register the child under the pretext that his mother resides in Britain for study purpose.

Lawyer Farid Mahajneh from the Jerusalem Center for Social & Economic Rights (JCSER), who followed up the case file, said the court accepted the Center's claims concerning the case of Haya Nofal, a Palestinian resident of Ras Al-Amud neighborhood in Occupied Jerusalem, who is currently in Britain where she studies pharmacy.

The applicant noted that it not allowed, by any means, for the Interior Ministry to refuse registering the child on her ID card just for staying abroad to pursue her study. This means that her residency is temporary, and therefore, there is no justification for not registering the child on the mother's ID card.

The lawyer pointed out that the Interior Ministry granted the child a two-year temporary residency permit, provided that the child's family should prove its 'center of life' is in Jerusalem. (After approaching the court, which approved our claims, it asked the Interior Ministry to examine the client's academic certificates in order to start with the registration of her child on her ID card).

The Center's Director General, said, 'the decision pertaining to Haya Nofal gains special importance, given the fact that it affects the rights of many individuals living abroad for study and over the previous years they were to subject to illegal procedures by the Interior Ministry that denies many of their rights, especially the right to residency.

He noted that the legal unit succeeded over the past few months in restoring the residency of many Jerusalemite families whose members were abroad either for study or work temporarily. Upon return, their ID cards were withdrawn by the Interior Ministry.

This case is a basis for other cases of Palestinian Jerusalemites who were subjected to illegal procedures by the Interior Ministry, which means restoration of their rights.
