Demolition of a Palestinian House Postponed for One Year and a Half

The Jerusalem Center for Social & Economic Rights (JCSER) has obtained a decision from the Israeli Central Court forcing the Interior Ministry to extend the validity period of the demolition order, which was issued over a year ago against Fahed Fathi Al-Joulani, a resident of the Jabal Al-Mukabber neighborhood, south of Occupied Jerusalem.

JCSERs lawyer, Ziad Qawar, who is following up the case, said the court decision came following a series of legal efforts stretching across five months.

According to a court decision issued on 9 July 2001, a 23,000-shekel fine was imposed on Mr. Al-Joulani, payable in fifty monthly installments. He also signed a 49,800-shekel bail bond, in return for obtaining a building permit by 1 January 2003, Mr. Qawar noted.

Due to Mr. Joulanis inability to obtain a building permit by 1 January 2003 - a failure caused by the strict restrictions imposed on building permits procedures - the Interior Ministry tried to demolish the house on 13 July 2003. Mr. Joulani was then forced to approach the Jerusalem Municipal Court, which at the time turned down the petition he had submitted to extend the period given to obtain a building permit. The Court set 23 August 2003 as the date for carrying out the demolition. At this point, JCSER was forced to approach the Central Court. During a court decision, the Courts three judges decided to give Mr. Al-Joulani a 14-month period to obtain a building permit.
