Legal Advisor Forces WJM to Open Licensing Files for Palestinian Jerusalemites

The West Jerusalem Municipalitys Legal Advisor has issued an order forcing the citys Licensing Department & the Construction and Organization Committee to open new licensing files for Palestinian Jerusalemites against whom the Jerusalem Municipal Court has submitted bills of indictments for violating building laws and regulations, and to follow up new and old ones.

Ashraf Seif, Head of JCSERs Legal Unit, sent an inquiry letter to the Municipalitys Legal Advisor, refuting the Licensing & Construction Committees policy with regard to its failure to follow up or open licensing files to Palestinian Jerusalemites against whom bills of indictments were submitted.

 

 

The Legal Advisors decision allows large numbers of Palestinian Jerusalemites against whom bills of indictments have been submitted for violating building laws to force the Municipality to review their licensing applications, many of which were submitted years ago but have been ignored over the years. The Municipality uses the bills of indictment as pretexts for failing to issue the necessary building licenses for Palestinian Jerusalemites who wish to build homes or additions to existing homes, thus forcing them to build without permits. As a result, home-owners face multiple penalties: high fines, imprisonment and even demolition of the property.

 

It is noted that over the past three years, the Municipality has intensified its policy of house demolition and its measures against building laws violators in Occupied Jerusalem. During the past three years (2000-2003), the Municipality demolished some 350 Palestinian houses and imposed building violations on hundreds of Palestinians.

According to the Municipalitys official sources, more than 6,000 houses have been built by Palestinian Jerusalemites over the past five years, which the Municipality claims were built without building licenses.
