Court Decisions Obtained to Prevent House Demolition in Beit Hanina

The Jerusalem Center for Social & Economic Rights (JCSER) has obtained court decisions forcing the West Jerusalem Municipality (WJM) to postpone the demolition of a house and a building consisting of one apartment and four shops in Beit Hanina, north of Occupied Jerusalem, in the wake of petitions submitted by lawyers Ashraf Seif and Ziad Qawar.

The Court agreed to postpone until 18 March 2004 the demolition of a building belonging to Issam Abu Eid, Fawzi, Nabil Ziadeh, Wael Yaghmout and Ahmad Tamimi.

Lawyer Ashraf Seif, who is following up the case, said, An administrative order, signed by the Jerusalem Mayor, was issued on 22/2/2004 and was put on the building on 29/2/2004. On 1/3/2004, the Center submitted an urgent appeal to the Court requesting that it freeze the demolition order. The Court complied with the request and set 18/3/2004 as a date to look into the case, in order to give the Municipality the opportunity to submit its claims.

Meanwhile, lawyer Ziad Qawar obtained a court decision to postpone until 31/12/2004 the demolition of a building belonging to Kamil Saou, a resident of Beit Hanina.

The postponement of the house demolition was made after Mr. Saou paid the amount of 10,000 shekels, in compliance with the judges request to cover the costs of the demolition, which was scheduled to take place on 25/2/2004, said Ziad Qawar.

The judge asked Mr. Saou to pay the amount of 15,000 shekels. However, the amount was reduced to 10,000 shekels due to his difficult financial situation, he added.
