Demolition of a Palestinian House Postponed

The Jerusalem Center for Social & Economic Rights (JCSER) has obtained a court decision temporarily preventing the demolition of Hatem Hussein Khalils house in the Al-Issawiyya neighborhood of northeast Occupied Jerusalem.

JCSER lawyer Farid Mahajneh, who is following up the case, said, On 1 Feb. 2004, the Jerusalem Municipality issued an administrative order to demolish Mr. Khalils house, prior to the Center approaching the court and requesting it to stop the demolition order. The legal examination of the file and the administrative order proved that the house was not inhabited for thirty days before the building supervision teams visit to the house, and that the house was not ready for sixty days before such visit.

According to the court decision, the demolition order comes into effect from 18/4 to l 18/5/2004. The demolition order becomes invalid if the house is not demolished by 18/5/2004.

Many Palestinians whose homes are threatened with demolition could benefit from this decision in accordance with the article of the building law, which states that the house should be inhabited thirty days before the building teams visit, and that the house should be ready for sixty days before such visit, Mr. Mahajneh said.
