Family Reunification Application Reviewed

In the wake of a petition submitted by the Jerusalem Center for Social & Economic Rights (JCSER) to the Israeli Central Court, the Israeli prosecution office has agreed to review Samer Al-Qawasmis family reunification application, which was submitted to the Israeli Interior Ministry in 1998.

JCSER lawyer Ziad Qawar, who is following up the case, said, the Interior Ministry had refused to respond to this application for over five years (1998 2003). On 3 March 2003, we received a letter from the Ministry stating its refusal to process the application, justifying its refusal by citing the Interior Ministers March 2002 decision to freeze action on such Palestinian family reunification applications. The freeze was approved by the Israeli government in May 2002.

As a result of the Ministrys refusal to review the application, we submitted a petition to the Israeli Central Court in May 2003, requesting it to force the Ministry to study the application, since it had been submitted before 31 March 2002 (i.e., before the Interior Ministers freeze.) In accordance with a decision taken by the Israeli Central Court last month, the Ministry is, therefore, forced to review existing family reunification applications, and to regard these applications as valid even if they were filed more than a year ago, added Mr. Qawar.

According to the recent decision, the Israeli prosecution office is required to comply with the Centers request that it studies Mr. Qawasmis application. The new decision will enable hundreds of Palestinian Jerusalemite families to ask that the Interior Ministry review their applications, on the same basis.
