The Jerusalem Center for Social and Economic Rights was able to attain a court order to stop the demolition order of a deceased (Abed Alqadir Abdeen) home in occupied Jerusalem and to close the file indefinitely.

 

Lawyer Fareed Mhajenah said, the sons of the deceased came to the Center June 11, 2004 after their father was served with a demolition order on April 2, 2000 to demolish a two story building without a building permit. The courts first session was on October 21, 2002 and due to the Abdeens health problems the court sessions were delayed many times. Abdeen died on June 17, 2003 and the court ordered to close the file indefinitely and the charges dropped. The West Jerusalem Municipality served the two sons of the deceased with the same charges on February 2, 2004. Claiming that they inherited the house without the building permit and they are using it at the time. The Municipality petitioned the court to impose a fine on the sons in the amount of 60,000 Shekels. In response, the Center petitioned the Internal Affairs Court that the sons dont own or use the house directly or indirectly. On June 15, 2004 the Municipality failed to produce enough evidence against the sons, the court ordered to drop the charges and to close the file indefinitely.
