A preliminary study prepare by Advocate Ashraf Saif, head of legal unit, warns against the new structural plan of East Jerusalem and especially the Old City. The West Jerusalem Municipality, the architect of the structural plan, lately disclosed some of the new its details.

The study shows that the preparation of the plan started early 2000 and the recent disclosure of the plan is of great importance because it is in time with the erection of the wall around East Jerusalem. Which implies the redrawing of Jerusalems city boundaries by the WJMs administration.

The study indicated the goals to be achieved from Jerusalems new structural plan. The primary goal of the new structural plan is to create a continuous plan setting in developing Jerusalem (East and West) as Israels Capital and to maintain a 70% Jewish and 30% Arab demographic balance. By preventing Jewish migration from Jerusalem, because a recent surveys project that Jerusalems demographic balance will be 40% Jewish and 60% Arab by the year 2020. Where the Jewish population will be a minority in Jerusalem by the year 2020.

The study also illustrates what it calls Urban Planning Obstacles in East Jerusalem and they are the following:
  1. The current building efforts in East Jerusalem is conducted without building permits and guided by political Palestinian entities.
  2. The nature of existing buildings is of village characteristics, unorganized, built at random and does not efficiently utilize the land as a source of beneficial development as it should.
  3. The lack of existence of appropriate urban design infrastructure despite what WJM claims that it invested in developing such infrastructure.

In the topic of land ownership, the WJM focus is on Urban Planning Obstacles where land ownership is unclear due to lack of land registration, reconciliation and development mechanisms. In addition, the lack of funding allocation to urban planning in East Jerusalem by WJM caused the Palestinian Jerusalemite to ignore the building codes, which lead to a wide range of illegal home building.

Land ownership reconciliation means land confiscation by Israeli authorities and consequently would lead to forced evacuation of Shufat and Qalandia refugee camps, Wadi Aljouz industrial area and Jerusalems Old City. At the same time WJM will attempt to raise funds claiming it is for improving the living conditions of Palestinian Jerusalemites. In addition, if this plan is ratified, then building permits applications will be considered according to the plan.

The Structural Plan from an international perspective

The study concludes that the proposed Israeli structural plan for Occupied East Jerusalem violates international law. In accordance with international law, East Jerusalem falls under the Geneva convention that protects occupied territories from the occupier and forbids the occupier enforcing any agenda that would affect the occupied territories residents and to preserve the original conditions of the affected area.

The moving of Shufat refugee camp, Wadi Aljouz industrial area, the changing of Old Citys features or land confiscation is a serious violation to international law. The study suggests a close watch of the proposed structural plan and its ratification process, because it could be modified leading to an increase in the

violations intensity.
