JCSER deplores Israeli war crime in Sheikh Jarah

In the very early hours of this morning, Israeli occupation forces raided Sheik Jarrah neighborhood in Jerusalem to forcibly evict the two Palestinian families of Hanoun and Ghawi which comprise of 70 individuals. During the storm, Israeli forces attacked members of the families and arrested several international solidarity activists.

This illegal eviction is the second step in evacuating the entire 28 families from their homes in the area in preparation to build a settlement enclave for extremists Jews.

The United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) built the targeted houses with eviction, under a joint construction project with the Jordanian government in 1956. The project aim was to provide shelter to the Palestinian families which were expelled and dispossessed from their original homes in West Jerusalem which was occupied in 1948.

Israeli occupation authorities also demolished the Al-Kurd family protest tent for the sixth time since the family was forcibly evicted from their Sheikh Jarrah home in November 2008. Bread winner of al-Kurd family died few days after the eviction.

These Israeli actions in Sheikh Jarrah and other areas in East Jerusalem which aim to displace Palestinians contravene the united calls of the international community, including the Quartet whose recent statement urged the Government of Israel to refrain from provocative actions in East Jerusalem, including house demolitions and evictions. These actions heighten tensions and undermine international efforts to create conditions for fruitful negotiations to achieve peace.

 

JCSER reminds the international community with its duty under the fourth Geneva Convention, which considers the Palestinian population as protected persons and Israel as the Occupying Power under international humanitarian law. The destruction and confiscation of private property not justified by military necessity, and the transfer of the Occupying Powers population into territory it occupies, is explicitly prohibited under international humanitarian law. Additionally, the right to adequate housing is firmly embedded as a fundamental guarantee under international human rights law. The Israeli occupation authorities campaign of eviction and demolition in Sheikh Jarrah amounts to the forcible transfer of protected persons within and from occupied territory; this in turn amounts to a war crime under international humanitarian law.

JCESR which condemns this war crime calls the international community to take all the needed steps to bring its perpetuator to justice and to increase their efforts to end the Israeli long occupation of the occupied territories in order to enable the Palestinian people to exercise their right in self-determination as other peoples of the world.
