JCSER asserts illegality of Jerusalem annexation by Israeli occupation

Print PDF

On May 11, Israeli occupation celebrates the so called "unification of Jerusalem," by organizing marches to Jerusalem and its Old City. During the provocative march, Israel deployed thousands of its security agents to secure the settlers while meanwhile banning the Palestinian residents of the city from heading to their homes during the passage of the march.

On their parts, Israeli leaders reiterate their rhetoric that Jerusalem will remain forever united and that they will continue to build in it, as echoed by Israeli Premier Benjamin Netanyahu. Some of them went even further by announcing that the government will demolish the Palestinian "illegal" homes in occupied Jerusalem.

However, the Jerusalem Center for Social and Economic Rights would like to reaffirm that the Israeli occupation's decision to annex occupied Jerusalem on July 30, 1980 is considered by the international community as illegal.

For example the UN Security Council resolution 478 which was adopted on August 20, 1980 rule out that the "all legislative and administrative measures and actions taken by Israel, the occupying power, which have altered or purport to alter the character and status of the Holy City of Jerusalem, are null and void and must be rescinded forthwith."

Moreover Article 49 of the Fourth Geneva Convention prohibits the "individual or mass forcible transfers, as well as deportations of protected persons from occupied territory "Neither shall "The Occupying Power.. deport or transfer parts of its own civilian population into the territory it occupies."

Consequently, JCSER, condemns the recent Israeli statements which inflame the already tensed situation in the city and call upon members of the international community to take their responsibility as stipulated in Geneva Conventions by taking actions to end the Israeli occupation of the entire Palestinian occupied territories including East Jerusalem to enable the Palestinian people to practice its basic right in self determination.

JCSER affirms that it is time for taking actions to implement decisions of international legality particularly which were adopted by the UN Security Council and General Assembly.
