JCSER condemns the municipality decision to demolish 22 Palestinian homes

Local planning and construction committee of the Israeli occupation's Jerusalem Municipality approved on Feb. 21, 2010 a plan to raze 22 Palestinian homes situated in al-Bustan area in the Jerusalem neighborhood of Silwan.

The Municipality plans to establish the so called "King David Garden" in place of the Palestinian homes slated for demolition. In al-Bustan areas 88 Palestinians homes have already received demolition orders which threaten to displace some 1500 Palestinian residents.

The Israeli Municipality decision comes at a time the US continues with its peace efforts in the proximity talks between the Palestinians and Israelis, a fact that shed lights on the true intentions of the Israeli occupation authorities which demolished since 1967 more than 9,000 Palestinian homes in the holy city.

Jerusalem Center for Social and Economic Rights, JCSER, condemns with strong words the Israeli decision to displace more Palestinians from their city and considers it a part of the Israeli old strategy to minimize the number of Palestinians in the city while increasing the number of Jews to make it impossible to become the capital of the Palestinian state.

JCSER would like to remind that according to Art. 25 p.1 of the Universal Declaration of Human Rights, "Everyone has the right to a standard of living adequate for the health and well-being of himself and for his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control."

Moreover, Art. 11 p. 1 of the International Covenant on Economic, Social, and Cultural Rights reads that "The States Parties to the present Covenant recognize the right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and to the continuous improvement of living conditions."

However, Art. 49 of the IV GC, stipulates that "Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or that of any other country, occupied or not, are prohibited, regardless of their motive."

Finally, JCSER calls upon the Israeli authorities to honor and abide by international law and to rescind its decision. Meanwhile, it calls upon the international community to mount its efforts to enable the Palestinian to emancipate from the Israeli longest occupation and exercise their right to self determination.
