Evacuation of Palestinian home in Absentia

"In 1948 my parents and 12 brothers emigrated from Jorat al-Inab (near Jerusalem Cinematheque), west of the Old City walls, to Silwan village after renting the house of Kayed Rajab in exchange of J.D. 18 annual rent. However, following the Israeli occupation of the Holy City, we traveled to the site of our old two-storey house in Jorat al-Inab and found it empty. It was surrounded with a garden. In 1973, the area was completely demolished.

In 1977, an employee from the Custodian of Absentees Properties paid a visit to my family. At that time, I was outside the country. The Israeli employee requested from my mother and brothers to testify before his organization about the way we moved to live in Silwan and when that took place.

The Custodian of Absentees Properties used to summon my mother and sisters once every year to demand them to leave the house which was established on area of 200 sq. meters, in exchange of obtaining an amount of money. However, members of my family used to reject that offer.

In 1996, I returned to the country from the Gulf countries, so when they summoned us that year, I accompanied my bother and brothers. I told the officials that we pay the annual rent to the person who rented the house to my father since 1948. That man was identified as Kayed Rajab the owner of the house in addition to other 5 dunums of land surrounding it. However, he later sold 4 dunums to local Palestinians living in the neighborhood.

I told him also that we had no intention to leave the house and that we did not know another owner other than Kayed Rajab.

In 1999, I received an order from the Israeli municipality of Jerusalem to demolish a small house which was built on an area of 70 sq. meters which situates near the original house. On my part, I abided by the municipality order and demolished the house on my own.

In 2007, we received a letter from a settlement group which I don't recall its name asking us to leave the house, because its ownership used to belong to settlers even before the establishment of the state of Israel. Since then, we had been engaged in court proceedings, after the settlers showed documents claiming their ownership of the land on which the house was built. Nevertheless, before two or three months, lawyer's of Dweikh family which resides near us was able to prove to the court that the documents of the settlers are in fact forged, knowing that Dweikh family had bought their land on which their house was built, from Kayed Rajab. In other words, he refuted the settlers' allegation of owning the land which is part of the lot on which our house had been established.

Nevertheless, on June 23, 2010 while I was watching al-Jazeera channel, I heard the news of an order to evacuate Abu Nab Family from its home in Silwan. I immediately called attorney Muhammad Dahleh, yet he affirmed that he hadn't received any decision from the Israeli Magistrate Court pertaining the evacuation order.

He also confirmed to me that the court did not convene any session to discuss the issue. However, he affirmed that he will follow the issue on June 27, 2010. It should be mentioned that three months ago, the lawyer requested to postpone the court session and that was done.

The house which comprises of two floors and built on 400 sq. meters provides shelter to 10 families consisting of 55 family members, half of them children.
