House Demolition Order Postponed & Bill of Indictment Cancelled

The West Jerusalem Municipality (WJM) has recently agreed to cancel the bill of indictment issued against Daoud Abu Naneh, a Palestinian Jerusalemite resident of Jabal Al-Mukabber, south of Occupied East Jerusalem, and to close the case lodged against him.

After approaching the Municipal Court, the Center's Legal Unit was able to force the Municipality to cancel the bill of indictment issued against Mr. Abu Naneh. The court exerted pressures on the Municipality, forcing it to retract the case and to cancel the bill of indictment.

In a special session held late October 2006, the Jerusalem Municipality refused to withdraw the case lodged against Mr. Abu Naneh, thus forcing the Center to approach the court. The latter refused the Municipality's request that the case be postponed, confirming that the case will be studied by the Court. The Municipality was, therefore, forced to dismiss the case and to cancel the bill of indictment.

In another development, the Jerusalem Municipal Court in West Jerusalem agreed to reduce the amount of fine imposed on Wafa' Mansour, a Palestinian resident of Jabal Al-Mukabber neighborhood, from 50,000 shekels to 30,000 shekels, payable in 60 equal monthly installments (an average of 500 shekels per payment).

On the other hand, the court refused to cancel the demolition order and agreed to postpone the demolition order until 01 May 2008, on condition that she takes the legal procedures necessary to obtain a building permit during this period. If she obtains a building permit, the demolition orders will be cancelled.
