Two Court Decisions Obtained to Postpone Demolition of Two Houses

The Jerusalem Center for Social & Economic Rights (JCSER) has recently obtained a court decision postponing the demolition order issued against Mohammed Eid Haddad until 01 January 2008 in order to give him enough time to follow up the legal procedures necessary to obtain a building permit.

In addition to postponing the demolition order, the court reduced the amount of the fine imposed on the client from 15,000 shekels to 8,000 shekels, payable in 16 equal monthly installments, an average of 500 shekels per payment.

The Center also obtained a decision from the Jerusalem Municipal Court in West Jerusalem postponing the demolition order issued against Ashraf Al-Ja'bari until 01 April 2008, in order to give him enough time to proceed with the legal procedures necessary to obtain a building permit. However, the Municipal Court imposed a 45,000-shekel fine on the client, and afterwards was reduced to 40,000 shekels after submitting a petition to the Central Court against it.

During a court session held on 19 March 2007, the Municipality requested that a 67,300-shekels fine be imposed on the client, in addition to issuing a prompt demolition order against the house under the pretext that the house is located in a public facility area.
